PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING GORILLAS 3. BY ACCESSING OR USING THIS APPLICATION YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE, DO NOT USE THIS APPLICATION.

1. Agreement and Parties

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Educacion Global ("Company", "we", "us", or "our"), the developer and owner of GORILLAS 3 ("App"). These Terms govern your access to and use of the App on any device, platform, or medium.

2. What GORILLAS 3 Is — and Is Not

GORILLAS 3 is an entertainment movement game. It uses your device camera solely to detect on-screen body movement responses for gameplay purposes.

GORILLAS 3 is NOT, under any circumstances:

• A medical device, diagnostic tool, or health monitor.
• A fitness, training, rehabilitation, or physical therapy program.
• A substitute for professional medical, nutritional, or exercise advice.
• Approved, certified, or endorsed by any health authority or regulatory body.

No content, output, score, or feedback generated by the App should be interpreted as medical or fitness guidance of any kind. Educacion Global expressly disclaims any representation to the contrary.

3. Physical Activity — Safety Warning

⚠ READ THIS SECTION CAREFULLY. FAILURE TO FOLLOW THESE WARNINGS MAY RESULT IN SERIOUS INJURY OR DEATH.

• Only use the App in a safe, clear, obstacle-free environment with adequate space to move freely.
• Stop all physical activity immediately if you experience pain, shortness of breath, dizziness, nausea, chest tightness, or any discomfort. Seek medical attention if symptoms persist.
• Consult a qualified physician or healthcare provider before beginning any exercise program, including use of this App, especially if you have any pre-existing medical condition, injury, or disability.
• Children under 13 must have explicit permission and direct supervision from a parent or legal guardian at all times while using this App.
• You are solely responsible for assessing your own physical fitness and exercising within your personal limits.
• Educacion Global assumes no responsibility whatsoever for any injury, accident, or health event arising from your use of the App.

4. Eligibility

You must be at least 13 years of age to use this App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet all eligibility requirements stated herein.

5. License Grant and Restrictions

Subject to your compliance with these Terms, Educacion Global grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, solely for your personal, non-commercial entertainment purposes.

You may NOT:

• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App.
• Rent, lease, loan, sell, sublicense, distribute, or otherwise transfer the App or any rights therein to any third party.
• Remove, alter, or obscure any proprietary notices, labels, or marks on the App.
• Use the App for any commercial purpose or for any public display, performance, or broadcast without prior written consent from Educacion Global.
• Use the App in any manner that could damage, disable, overburden, or impair any server or network connected to the App.
• Attempt to gain unauthorized access to any portion of the App, other accounts, computer systems, or networks connected to the App.
• Use automated scripts, bots, or other means to interact with the App in an unauthorized manner.
• Use the App for any unlawful, harmful, fraudulent, or abusive purpose.

Any breach of this Section will result in the immediate termination of the license granted herein and may subject you to civil and/or criminal liability.

6. Intellectual Property

The App, including all content, graphics, user interface, audio, video, software, code, design, and all intellectual property rights therein, are and shall remain the exclusive property of Educacion Global and its licensors. These Terms do not convey to you any ownership interest in or to the App. All rights not expressly granted herein are reserved by Educacion Global.

"GORILLAS 3", the GORILLAS 3 logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Educacion Global. You must not use such marks without prior written permission.

7. The Season Pack — In-App Purchases

Week 1 content is available free of charge. The Season Pack is a one-time in-app purchase that unlocks the full season of content. All purchases are processed exclusively by Apple through the App Store and are subject to Apple's End User License Agreement and purchase terms.

All purchases are final and non-refundable except as required by applicable law or as permitted under Apple's refund policies. Educacion Global does not process payments and has no access to your payment information. For refund requests, contact Apple directly. You may restore a prior purchase at any time via Settings → Restore Purchases.

8. Privacy and Camera Use

The App requests access to your device camera solely to enable gameplay movement detection. Camera data is processed entirely on-device in real time and is not recorded, stored, transmitted, or shared with Educacion Global or any third party. Your privacy is important to us. 9. Disclaimers of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EDUCACION GLOBAL EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES THAT THE APP WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR RESULTS OBTAINED THROUGH THE APP.
• WARRANTIES THAT ANY DEFECTS IN THE APP WILL BE CORRECTED.

YOUR USE OF THE APP IS ENTIRELY AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EDUCACION GLOBAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES.
• PERSONAL INJURY, BODILY HARM, OR PROPERTY DAMAGE ARISING FROM OR RELATED TO YOUR USE OF THE APP.
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.

THIS LIMITATION APPLIES WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT EDUCACION GLOBAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF ANY LIMITATION IS HELD UNENFORCEABLE, THE APPLICABLE LIABILITY SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $10.00, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Educacion Global and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any physical injury or property damage caused by your activities in connection with the App.

12. Third-Party Services

The App may interact with third-party services (e.g., Apple App Store, Apple's StoreKit). Educacion Global is not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed solely by their respective terms and policies.

13. Termination

Educacion Global reserves the right, in its sole discretion, to suspend, restrict, or terminate your access to the App at any time and for any reason, including violation of these Terms, without notice or liability. Upon termination, all licenses granted herein immediately cease. Sections 6, 9, 10, 11, 14, and 15 shall survive any termination.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding individual arbitration. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

15. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Educacion Global regarding the App and supersede all prior agreements or understandings.

16. Changes to These Terms

Educacion Global reserves the right to update or modify these Terms at any time. We will indicate the date of the most recent revision at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App immediately.
